Terms of service
TERMS OF SERVICE
1. About these terms
Welcome to Bone Broth Mama. These Terms of Service apply when you visit bonebrothmama.com, create an account, place an order, purchase a subscription, or otherwise use our online store and related services.
“Bone Broth Mama,” “we,” “us,” and “our” refer to Bone Broth Mama.
By placing an order, you confirm that you have had the opportunity to review these Terms of Service and the policies referred to in them.
These Terms apply primarily to purchases made by consumers. Separate terms may apply to wholesale or other business-to-business purchases.
Nothing in these Terms limits any rights that you have under mandatory Dutch or European consumer law.
2. Accounts and customer information
You must provide accurate and current information when placing an order or creating a customer account.
You are responsible for keeping access to your account secure. Please contact us if you believe your account has been accessed without your permission.
You must have the legal capacity to enter into a purchase agreement. If you are under the age at which you can legally enter into such an agreement independently, a parent or legal guardian must act on your behalf.
3. Our products
Bone Broth Mama makes and sells food and related products, including chilled products that require appropriate storage.
We make reasonable efforts to describe and photograph our products accurately. Natural products may vary slightly in colour, texture, appearance, consistency, or other characteristics from batch to batch.
Ingredients, allergens, storage instructions, and other relevant product information are provided on product pages, packaging, labels, or accompanying information where applicable. Please review allergen and ingredient information before purchasing or consuming a product.
Product availability may change, and we may discontinue products or temporarily limit quantities.
4. Orders
When you submit an order, you are offering to purchase the products shown in your order.
After we receive your order, you will receive an electronic confirmation. We may contact you if there is a problem with availability, payment, delivery information, or another element of the order.
We may decline or cancel an order where reasonably necessary, including because a product is unavailable, there is an obvious pricing or technical error, payment cannot be processed, or we reasonably suspect fraud or misuse.
If we cancel an order after payment has been taken, we will refund the relevant amount.
Please review your order carefully before completing checkout.
5. Prices, VAT and payment
Prices displayed to consumers on our online store include applicable VAT unless clearly stated otherwise.
Any applicable delivery or other additional charges will be shown before you complete your purchase.
The total amount payable will be displayed during checkout and confirmed in your order confirmation.
Payment is processed using the payment options made available through our store. Payment information may be processed by Shopify and/or the relevant payment provider in accordance with their terms and privacy practices.
Promotional prices and discounts may be subject to additional conditions shown with the relevant promotion.
6. Delivery and pickup
Available delivery areas, pickup locations, delivery fees, schedules, and other current delivery information are described in our Shipping & Delivery Policy and shown where applicable during checkout.
You are responsible for providing complete and accurate delivery or contact information.
Where we arrange delivery, the risk of loss or damage remains with us until you, or a person you have designated other than the carrier, physically receives the order, except where applicable law provides otherwise.
For pickup orders, please wait until you receive notification that your order is ready before collecting it.
Chilled products should be refrigerated promptly after delivery or pickup and stored according to the instructions provided with the product.
If an event outside our reasonable control affects delivery, we will take reasonable steps to inform you and arrange an appropriate solution. Your statutory rights relating to delayed or failed delivery remain unaffected.
7. Returns, withdrawal rights and problems with an order
Your rights to cancel or return an online purchase depend on the type of product purchased and applicable consumer law.
Where the statutory right of withdrawal applies, consumers generally have 14 days to withdraw from an online purchase without giving a reason.
Certain statutory exceptions may apply, including for goods that are liable to deteriorate or expire rapidly and, where legally applicable, sealed goods that are not suitable for return for health or hygiene reasons after the seal has been broken.
Further details are provided in our Return & Refund Policy.
These rules do not affect your rights if a product is damaged, incorrect, defective, unsafe, or otherwise does not conform to the purchase agreement. If there is a problem with your order, please contact us as soon as reasonably possible at bonebrothmama@icloud.com.
Customers are responsible for following storage and handling instructions after receiving their products. This does not affect your rights in relation to a product that was already defective or non-conforming when supplied.
8. Subscriptions
Where a product is offered as a subscription, the applicable price, billing frequency, delivery frequency, discounts, and other subscription details will be shown before you complete checkout.
Subscriptions renew automatically according to the frequency selected when the subscription is purchased until the subscription is paused, cancelled, or otherwise ended.
You may manage available subscription options through your customer account or by contacting us at bonebrothmama@icloud.com.
Cancelling a subscription prevents future recurring subscription orders. Cancellation does not automatically cancel an individual order that has already been processed.
Further information is provided in our Purchase Options Cancellation Policy.
Any statutory consumer rights that apply to an individual purchase remain separate from your contractual right to cancel a subscription.
9. Relationship with Shopify
Bone Broth Mama is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Bone Broth Mama.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bone Broth Mama, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bone Broth Mama.
10. Third-party services and links
Our website may include services, tools, payment functionality, links, or other features provided by third parties.
Those third parties may have their own terms and privacy policies. Bone Broth Mama is not responsible for the content or operation of third-party websites or services that are outside our control.
Nothing in this section limits any responsibility that Bone Broth Mama has under applicable law for services used by us to fulfil our obligations to you.
11. Intellectual property
The content of the Bone Broth Mama website, including our branding, logos, photographs, product imagery, recipes, written content, graphics, and design elements, belongs to Bone Broth Mama or is used by us with permission and is protected by applicable intellectual-property law.
You may use the website for your own personal, non-commercial purposes.
You may not reproduce, republish, distribute, sell, commercially exploit, or materially modify our content without our prior permission, except where permitted by law.
Shopify and other third-party names and trademarks remain the property of their respective owners.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy.
Because our store is hosted by Shopify, Shopify also processes certain information in connection with providing the ecommerce platform and related services.
Please review our Privacy Policy for further information about how personal information is collected, used, and shared.
13. Acceptable use of the website
You may not use our website or services:
- for unlawful or fraudulent purposes;
- to interfere with the operation or security of the website;
- to transmit malicious code;
- to infringe another person's rights;
- to provide false or misleading information;
- to gain unauthorized access to systems or accounts; or
- in another manner that violates applicable law.
We may take proportionate steps to restrict access where reasonably necessary to protect our website, customers, or business.
14. Liability and consumer rights
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
Nothing in these Terms limits your statutory rights as a consumer, including rights relating to conformity, defective products, delivery, refunds, or other mandatory consumer protections.
To the extent permitted by law, Bone Broth Mama is not responsible for losses that could not reasonably have been foreseen when the agreement was made or for losses arising from use of the products contrary to clear storage, safety, or usage instructions.
This section does not limit liability for death or personal injury caused by negligence, fraud, deliberate misconduct, product liability that cannot lawfully be excluded, or any other liability that cannot legally be limited.
15. Changes to our Terms
We may update these Terms from time to time, for example because our services change or legal requirements are updated.
Changes will apply to future purchases from the effective date of the updated Terms.
For an existing subscription or other ongoing agreement, we will only make changes where permitted by the agreement and applicable law. Where legally required, we will inform you of changes in advance and provide any applicable right to cancel.
The version applicable to an individual purchase is generally the version made available when that purchase was made, unless applicable law provides otherwise.
16. Complaints and customer service
If you have a question, concern, or complaint about an order or our services, please contact:
Email: bonebrothmama@icloud.com
Phone: +31 6 3611 7154
We will make reasonable efforts to resolve complaints directly with you.
Your statutory rights to seek other remedies or use applicable consumer dispute procedures remain unaffected.
17. Governing law
These Terms and agreements with Bone Broth Mama are governed by Dutch law.
If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections that apply to you under applicable law.
Any dispute will be dealt with by a court having jurisdiction under applicable law. Nothing in these Terms requires a consumer to bring a claim exclusively before a court where such a requirement would be contrary to mandatory consumer law.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will apply only to the extent legally permitted and the remaining provisions will continue to apply.
